Epic Games has once again applied for the "Megaverse" trademark, with the new application covering goods and services in Classes 09, 38, 41, and 42. The company's previous trademark applications containing the term "Megaverse" faced opposition, ultimately resulting in a reduction of the applied-for classes.
In 2022, Epic Games applied for the "Epic Games Megaverse" trademark, covering six classes: 09, 35, 38, 41, 42, and 45. At that time, another company, Megaverse Ltd., already held the "Megaverse" trademark, and there were similarities in the declared goods and services of both parties.
Megaverse Ltd. filed an opposition against Epic Games' application in 2023. The dispute concluded in 2025 with the opponent prevailing, and Epic Games' application was ultimately retained only for Classes 35 and 45.
The relevant ruling stated that adding the company name "Epic Games" before "Megaverse" was insufficient to create adequate distinction between the two trademarks. The ruling also noted that consumers might interpret the company name separately from the product name when reading it.
This new application uses "Megaverse" directly. All four listed classes appeared in the previous application and overlap with the goods and services covered by Megaverse Ltd.'s trademark, particularly in Class 09. Megaverse Ltd.'s trademark remains valid; it is yet to be determined whether the new application will face opposition again.
In the previous dispute, Epic Games was required to pay £700 in fees to the opposing party. The old "Epic Games Megaverse" trademark remains valid with the United States Patent and Trademark Office, while this new application has not yet appeared in the US.
